Agreement to Terms

By accessing or using Buy Sell Disc ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, buyers, sellers, and others who access or use the Service.

Use of the Service

Eligibility

You must be at least 18 years old to use our Service. By using the Service, you represent and warrant that you are of legal age to form a binding contract.

Account Registration

To access certain features, you must register for an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your password
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

Seller Terms

Store Creation

Sellers must:

• Complete store verification and approval process
• Set up a Stripe Connect account for payment processing
• Provide accurate product descriptions and images
• Maintain adequate inventory levels
• Respond promptly to buyer inquiries and orders

Product Listings

You agree that all product listings:

• Are accurate and not misleading
• Do not infringe on intellectual property rights
• Comply with all applicable laws and regulations
• Are for disc golf products only
• Include clear condition descriptions for used items

Fees and Payments

Buy Sell Disc charges a 10% commission on completed sales. This fee is deducted from the seller's payout. Payment processing fees are handled separately by Stripe. Sellers receive payouts according to Stripe's payment schedule.

Buyer Terms

Purchases

When you make a purchase:

• You agree to pay the listed price plus applicable shipping and taxes
• Payment is processed securely through Stripe
• Orders are binding once payment is confirmed
• You are responsible for providing accurate shipping information

Returns and Refunds

Return and refund policies are set by individual sellers. Buy Sell Disc facilitates communication between buyers and sellers but is not responsible for resolving disputes. We encourage buyers and sellers to communicate directly regarding any issues.

Prohibited Conduct

You agree not to:

• Use the Service for any illegal purpose
• Violate any laws in your jurisdiction
• Infringe on intellectual property rights
• Transmit any viruses, malware, or harmful code
• Attempt to gain unauthorized access to the Service
• Interfere with or disrupt the Service
• Create false or misleading listings
• Engage in fraudulent transactions
• Harass, abuse, or harm other users

Intellectual Property

The Service and its original content, features, and functionality are owned by Buy Sell Disc and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of content you post, but grant us a license to use, display, and distribute your content on the Service.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not warrant that:

• The Service will be uninterrupted or error-free
• Defects will be corrected
• The Service is free of viruses or other harmful components

We are not responsible for the quality, safety, or legality of products listed by sellers, or the accuracy of product descriptions.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUY SELL DISC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

You may terminate your account at any time by contacting us or through your account settings.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Buy Sell Disc operates, without regard to its conflict of law provisions.
